1. ABOUT DS CREABAGS

These Terms of Service apply to purchases made through the DS Creabags website and to the use of this website.

Throughout these Terms, “DS Creabags”, “I”, “me” and “my” refer to the business operated by Dagmar Svetinska.

By placing an order through this website, you agree to these Terms of Service together with the policies referred to in them.

Nothing in these Terms limits or excludes any mandatory rights granted to consumers under applicable Luxembourg or European Union consumer law.

2. THE PRODUCTS

DS Creabags creates handmade crochet handbags and accessories in Luxembourg.

Each piece is created individually and is not mass-produced.

Because of the handmade nature of the products, slight variations in crochet texture, dimensions, positioning, colour appearance and finishing may occur from one piece to another. These small variations are part of the individual character of a handmade product and do not in themselves constitute a defect, provided that the product remains in conformity with the sales contract and applicable law.

I make every reasonable effort to display product colours, dimensions, materials and other characteristics accurately. However, colours may appear slightly different depending on the customer's screen or device.

Customers should review the product description, dimensions and photographs carefully before placing an order.

3. PRICES

All prices displayed on the website are shown in euros (€), unless otherwise indicated.

DS Creabags operates under the applicable Luxembourg small-business VAT exemption regime. VAT is therefore not added to the displayed product price where the exemption applies.

Delivery costs, where applicable, are shown during checkout before the customer confirms the order.

Prices may be changed at any time. A price change will not affect an order that has already been accepted, except where an obvious pricing or technical error has occurred and applicable law permits the order to be corrected or cancelled.

4. ORDERS AND PAYMENT

An order is placed when the customer completes the checkout process and submits the order with an obligation to pay.

The customer is responsible for providing complete and accurate billing, delivery and contact information.

After an order is placed, the customer will receive an electronic order confirmation.

DS Creabags reserves the right to refuse or cancel an order where there is a legitimate reason to do so, including suspected fraud, an obvious pricing or technical error, inability to obtain necessary materials, product unavailability, inability to deliver to the selected destination or suspected unauthorised commercial resale.

If DS Creabags cancels an order after payment has been received, the amount due to the customer will be refunded in accordance with applicable law.

5. DELIVERY AREA

DS Creabags currently accepts online orders for delivery only to European Union destinations made available at checkout.

Available delivery destinations may change from time to time.

If a country or destination is not available during checkout, DS Creabags does not currently offer online delivery to that destination.

Customers are responsible for providing a complete and accurate delivery address.

6. DELIVERY

Available products will be prepared and dispatched within the timeframe indicated on the website or communicated to the customer.

Because DS Creabags is an independent handmade business, preparation times may differ from those of mass-produced products.

Where a product is made after ordering, personalised or pre-ordered, a separate estimated completion timeframe may apply. This will be communicated to the customer before or when the order is confirmed.

If a significant delay occurs, I will contact the customer as soon as reasonably possible.

Nothing in this section limits the customer's statutory rights concerning delivery.

7. RIGHT OF WITHDRAWAL – STANDARD PRODUCTS

Consumers purchasing standard, non-personalised products online generally have a statutory right to withdraw from the contract within 14 calendar days without giving a reason.

For goods, the withdrawal period generally begins on the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.

To exercise the right of withdrawal, the customer must inform DS Creabags clearly of their decision to withdraw before the withdrawal period expires.

A customer may use the statutory withdrawal form where applicable, but a clear statement communicating the decision to withdraw is also acceptable.

After notifying DS Creabags of the withdrawal, the customer must return the goods within the applicable legal timeframe.

Unless otherwise agreed or required by law, the customer is responsible for the direct cost of returning goods when exercising the statutory right of withdrawal.

The customer should handle the product only to the extent necessary to establish its nature, characteristics and functioning. The customer may be responsible for any diminished value resulting from handling beyond what is necessary for this purpose.

Refunds following a valid statutory withdrawal will be made in accordance with applicable law.

8. PERSONALISED AND CUSTOM ORDERS

Certain DS Creabags products may be created according to specifications individually agreed with the customer.

Depending on the order, this may include individually agreed combinations of colours, materials, dimensions, construction or other design details.

Before production begins, the agreed specifications, total price and estimated production timeframe will be confirmed with the customer.

For personalised or custom orders, a 50% deposit of the total product price is required to confirm the order and begin production.

The remaining 50% balance is payable when the product is completed and before dispatch.

The product will be dispatched only after full payment has been received.

Under applicable consumer law, the statutory right of withdrawal may not apply to goods that are made to the consumer's specifications or are clearly personalised.

Where this legal exception applies and production has begun, cancellation will normally not be possible and the 50% deposit will be non-refundable, except where otherwise required by law or expressly agreed by DS Creabags.

Customers considering a change or cancellation should contact info@dscreabags.com as soon as possible. I will consider whether a requested change can reasonably be accommodated depending on the stage of production.

The personalised nature of a product does not affect the customer's statutory rights where a product is defective or does not conform to the contract.

9. PRE-ORDERS

DS Creabags may occasionally offer standard products for pre-order before they are immediately available.

Unless otherwise stated on the relevant product page, a pre-order requires a 50% deposit of the total product price when the order is placed.

The remaining 50% balance will be requested when the product is ready and must be paid before dispatch.

Estimated completion or availability dates are estimates because the products are handmade. If a significant delay occurs, the customer will be informed.

A standard, non-personalised pre-order does not in itself remove a consumer's statutory right of withdrawal or other mandatory consumer rights.

Where a valid statutory withdrawal applies, amounts already paid will be reimbursed in accordance with applicable law.

Additional conditions are provided in the Pre-Order Policy where applicable.

10. RETURNS AND REFUNDS

Returns and refunds are handled in accordance with applicable consumer law and the DS Creabags Refund & Returns Policy.

Nothing in the Refund & Returns Policy or these Terms limits the customer's mandatory statutory rights.

11. LEGAL GUARANTEE OF CONFORMITY

Consumers benefit from the legal guarantee of conformity provided by Luxembourg and applicable European Union consumer law.

For consumer goods, the statutory legal guarantee is generally 2 years.

If a DS Creabags product is defective, does not correspond to its description or otherwise does not conform to the sales contract, the customer should contact:

with the order information and details of the issue.

The customer's rights and remedies will be handled in accordance with applicable law.

Nothing in these Terms excludes or limits the customer's statutory rights concerning defective or non-conforming goods.

12. CARE OF HANDMADE PRODUCTS

DS Creabags handbags are handmade and should be used and cared for appropriately.

Customers should follow any care instructions provided on the relevant product page or with the product.

Damage resulting from inappropriate use, accidents, improper storage, excessive loading, failure to follow reasonable care instructions or normal wear and tear is distinguished from a lack of conformity or manufacturing defect, subject always to the customer's mandatory legal rights.

13. INTELLECTUAL PROPERTY

Unless otherwise stated, the DS Creabags name, original handbag designs, photographs, product descriptions, text, graphics, logos, website content and other original materials displayed on this website are owned by or used with permission by DS Creabags.

Content may not be copied, reproduced, distributed, commercially exploited or used to create derivative commercial material without prior written permission, except where such use is permitted by applicable law.

14. WEBSITE USE

Customers and visitors must not use the DS Creabags website:

  • for unlawful or fraudulent purposes;

  • to infringe intellectual property or other legal rights;

  • to transmit viruses, malicious software or other harmful code;

  • to attempt to interfere with the security or operation of the website;

  • to collect personal information unlawfully;

  • to submit false or misleading information; or

  • to use automated means to interfere with or misuse the website.

Access to the website may be restricted where necessary to protect DS Creabags, customers, the website or other users from unlawful or harmful activity.

15. THIRD-PARTY SERVICES AND LINKS

The DS Creabags online store is hosted using Shopify's ecommerce platform.

The website may also use services provided by third parties, including payment, delivery, analytics or other technology providers.

Links to external websites may occasionally be provided for convenience. DS Creabags is not responsible for the content or practices of independent third-party websites.

Use of third-party services may also be subject to the relevant provider's terms and privacy practices.

16. PERSONAL INFORMATION

Personal information is processed in accordance with the DS Creabags Privacy Policy and applicable data-protection law.

Customers should review the Privacy Policy for information about how personal data is collected, used, stored and protected and about the rights available to them.

17. LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, nor does anything in these Terms exclude or restrict any mandatory consumer right or remedy.

To the extent permitted by applicable law, DS Creabags is not responsible for losses resulting from circumstances outside its reasonable control.

Nothing in this section affects statutory rights relating to defective or non-conforming products.

18. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted by law or, where necessary, treated as severed from these Terms.

The remaining provisions will continue to apply.

19. GOVERNING LAW

These Terms and contracts concluded through the DS Creabags website are governed by the laws of the Grand Duchy of Luxembourg.

Nothing in these Terms deprives a consumer of mandatory protections available to them under applicable consumer law.

20. CHANGES TO THESE TERMS

DS Creabags may update these Terms from time to time, for example to reflect changes to the website, business practices or applicable legal requirements.

The version applicable to an order is the version in effect when the order is placed, unless applicable law requires otherwise.

The current version will be made available on the DS Creabags website.
